Italian Authorities Suspend Access to Open AI's Chat GPT and Launch Investigation into Data Collection Practices

On March 31st, Italian authorities announced that they have suspended access to Chat GPT, an artificial intelligence program developed by Open AI, a Microsoft-funded startup. The authorities are launching an investigation into whether the massive data collection by the program violated the law on the protection of personal data. They have also pointed out that the age verification of users has some shortcomings. This move makes Italy the first Western country to ban the use of chat GPTs.

Open AI Yet to Respond to Request for Comment

Open AI, the operator of the chat GPT, has 20 days to take corrective measures; otherwise, it could be fined up to 4% of its annual turnover. Despite attempts to contact Open AI, the company has not provided any response to this issue.

As of March 31st, Italian users could still access the site since it was practically impossible to block access on the same day. However, authorities plan to block access by the 1st of January.

It is noteworthy that Chat GPT is already not available in mainland China, Hong Kong, Iran, Russia, and parts of Africa, and Open AI accounts cannot be created in these regions. Italian authorities are investigating whether the data collection practices of the program violate the EU's GDPR (General Data Protection Regulation).

Importance of Compliance with Data Protection Laws

It is essential to acknowledge that this move is not an isolated event and could be replicated by other data protection authorities in EU member states under the GDPR. The rapid development of AI has raised concerns about its ethical use and its potential to violate privacy rights. This move by the Italian authorities serves as a reminder that companies must comply with regulations and laws, especially when it comes to the collection and use of personal data.

The suspension of Chat GPT in Italy highlights the importance of data protection laws and regulations in the age of AI. As the use of AI continues to grow, it is essential for companies to take responsibility and ensure that their practices do not infringe on individuals' privacy rights.
